1. Acceptance of Terms

By accessing or using Aegyo Studio ("the Service"), operated by Risk Averse Technology Company ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Aegyo Studio is an AI-powered video generation service that transforms user-uploaded photos into animated videos featuring K-pop style "aegyo" expressions and movements. The Service uses third-party AI models to generate video content.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

You must be at least 18 years old to create an account and use this Service.

4. Credits and Payments

The Service operates on a credit-based system:

  • Free tier users receive limited access to basic features
  • Credits can be purchased to access premium features
  • Credits are non-refundable once used
  • Unused credits do not expire
  • Credits cannot be transferred between accounts

All payments are processed securely through Stripe. We do not store your payment card information.

5. User Content

By uploading photos to the Service, you represent and warrant that:

  • You own the rights to the photos or have permission to use them
  • The photos are of yourself or you have explicit consent from the person depicted
  • The photos do not violate any laws or third-party rights
  • The photos do not contain minors (users must be 18+)

You retain ownership of your original photos. By using the Service, you grant us a limited license to process your photos for the purpose of generating videos.

6. Generated Content

Videos generated by the Service:

  • Are created using AI technology and may not be perfect
  • May be used for personal and commercial purposes
  • Should not be used to deceive, defraud, or mislead others
  • Should not be presented as real footage if shared publicly

Free tier videos are hosted temporarily (approximately 7 days) and may be deleted without notice. Premium tier videos are stored permanently in your account.

7. Prohibited Uses

You agree not to use the Service to:

  • Create content depicting minors
  • Create non-consensual intimate imagery
  • Harass, defame, or harm others
  • Create deepfakes for fraud, deception, or misinformation
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Circumvent usage limits or abuse free credits

We reserve the right to terminate accounts that violate these terms without refund.

8. Third-Party Services

The Service relies on third-party AI providers (including fal.ai) for video generation. These providers have their own terms of service and privacy policies. We are not responsible for the actions or policies of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Generated videos will meet your expectations
  • Results will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Risk Averse Technology Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the Service or sending you an email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
